- Scope
The following general terms and conditions in the version valid at the time of the order apply exclusively to the business relationship between Thunderbird Projects AG and our customers. Thunderbird Projects AG does not recognize any deviating general terms and conditions of the customer unless Thunderbird Projects AG has expressly agreed to their validity in writing.
- Order
By clicking on the "Buy" button, the customer places a binding order that represents a contractual offer. Before submitting their order, the customer has the opportunity to check the data they have entered and, if necessary, change it in the "Payment" section. After submitting the order, an email is sent to the customer confirming receipt of the order and listing its details. This order confirmation does not constitute acceptance in the sense of sales law, but is only intended to inform our customers that their order has been received by tb-store.com. The purchase contract is only concluded when the ordered goods are dispatched. The contract is concluded and processed in German. Thunderbird Projects AG reserves the right not to provide the promised service and to refund the purchase price to our customers if the goods cannot be delivered or are temporarily unavailable despite the prior conclusion of a corresponding purchase contract.
- Delivery
Unless otherwise agreed, the delivery of your purchased products will be made in advance. Your shipping costs will be CHF 10.00 or CHF 15.00 for goods worth less than CHF 150.00 or CHF 200.00. We deliver free of charge for goods worth over CHF 150.00 per order. Packaging costs are generally borne by Thunderbird Projects AG . If partial deliveries are necessary , Thunderbird Projects AG will cover the additional costs. We only process orders with advertising if payment is made in advance.
- Prices and minimum order value
All prices stated in the catalogue and on the Internet include the applicable VAT.
- Retention of title
Ownership of the delivered products shall only pass to our customers upon full payment of the purchase price, unless ownership has previously been transferred by law.
- Cancellation policy
Right of withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last good.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Exceptions to the right of withdrawal:
The right of withdrawal does not apply to customers in Switzerland. Customers from abroad currently have no option to cancel their orders.
Consequences of revocation:
If you cancel this contract, we will refund all payments that we have received from you, excluding delivery costs, promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract or the goods were returned to us.
For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
- Liability
If the goods are defective, the statutory provisions on liability for defects apply. Thunderbird Projects AG accepts no liability for damages resulting from incomplete, delayed or non-delivery if these are caused by fire, strikes, lockouts, force majeure or other circumstances beyond our control. In the event of non-delivery or delayed delivery by sub-suppliers , Thunderbird Projects AG is entitled to withdraw from the contract with the customer if the goods are not or temporarily unavailable despite the prior conclusion of a corresponding purchase contract. Thunderbird Projects AG undertakes to inform the customer immediately of the unavailability and to reimburse the customer immediately for any consideration. Thunderbird Projects AG is only liable for intent and gross negligence. The same applies to the personal liability of employees, representatives and vicarious agents. However, this limitation of liability does not apply to personal injuries, to claims under the Product Liability Act, to the case of fraudulent concealment of a defect or to the violation of essential contractual obligations, whereby in the latter case liability is limited to the foreseeable, typically occurring damage. The statutory claims of our customers are not waived by the above limitations of liability.
- Payment terms
At tb-store.com you can choose between the following payment options: credit card, Paypal, Twint. Purchase on account possible for registered business customers (creditworthiness required), partial payments in WIR possible by arrangement. The business customer is in default at the latest if he does not pay Thunderbird Projects AG within 30 days of receipt of the invoice or equivalent payment statement. In the event of late payment, we charge interest on arrears of 5%.
- Effectiveness of the terms and conditions
Should one or more points of these terms and conditions be or become invalid, this will not affect the validity of the remaining points or the validity of the contract as a whole. The invalid provision will be replaced by a provision whose effects come as close as possible to the economic objective that the contracting parties were pursuing with the invalid provision.
- Jurisdiction and applicable law
Swiss law shall apply exclusively to all legal issues between the customer and Thunderbird Projects AG . The parties agree that the place of jurisdiction shall be the registered office of the branch of Thunderbird Projects AG in Binningen BL, whereby Thunderbird Projects AG reserves the right to alternatively sue the customer at his or her registered office or place of residence.
- Data protection
The processing of your personal data is subject to the applicable data protection laws. We process the personal data received and collected about you for the purposes of concluding and executing the contract, for communicating with you, for planning and assessing the business activities and for marketing purposes of our group of companies, including sending catalogs and advertising by email. The data may also be transmitted to partner companies for their purposes as part of the order and contract processing. We may outsource our data processing to third parties in Germany and abroad and disclose your data to other group companies for the purposes mentioned. We may also make your personal data available to partner companies for their marketing purposes (including sending emails). By placing your order, you consent to the processing of your data as described above. You can object to the use of your data for advertising purposes (including email advertising) at any time free of charge by notifying us. You also agree that we may transmit your personal data, including to a debt collection agency, for the purposes of credit checks and debt collection.
