The responsible body for the processing of your personal data (hereinafter: data) is

Thunderbird Projects AG
Kirchbühlstrasse 20
3818 Grindelwald

Further contact details of the responsible body can be found in the imprint.

Please send any questions, complaints or requests for information regarding data protection by email to datenschutz@thunderbird.ch or with the addition “Data Protection” to the above address.

The legal basis for the processing is the Swiss Data Protection Act (DSG) and the Swiss Ordinance on the Federal Act on Data Protection (VDSG).

II. What data processing takes place?
  1. Orders

We use data that you provide to us during the ordering process (e.g. name, addresses, email addresses, bank details) to fulfill contracts or carry out pre-contractual measures. We can also process the data you provide to inform you about other interesting products from our portfolio.

Why is this data processed?

Order processing: We process this data for the purposes of order processing, shipping, invoicing, payment processing, customer service, debt collection and, if necessary, to enforce or defend legal claims arising from the delivery relationship. We are supported in order processing by external service providers (call center agencies). They process your data exclusively in accordance with our instructions and not for their own purposes. If invoices are not paid despite repeated reminders, we will, if necessary, transmit data to debt collection companies for the purpose of escrow collection.

Shipping of the ordered goods: The shipping of the ordered goods is handled in cooperation with various transport companies. We pass on the data required for the purpose of delivering the ordered goods to these transport companies. If you order goods from third-party suppliers (purchased goods) in our online shop, we may pass on your personal data to them for the purpose of direct shipping.

Credit check: In principle, we offer you various payment options. If you choose an unsafe payment method (e.g. purchase on account), we have a legitimate interest in protecting ourselves against possible payment defaults. For this purpose, we may obtain a credit report from CRIF AG, Hagenholzstrasse 81, 8050 Zurich before granting these payment methods. To do this, we transmit the data required for a credit check and use the information received on the statistical probability of a payment default to make a balanced decision on the establishment, implementation or termination of the contractual relationship. The credit report may contain probability values (score values) that are calculated on the basis of scientifically recognized mathematical-statistical procedures and whose calculation includes, among other things, address data. Your legitimate interests will be taken into account in accordance with the legal provisions. Depending on your score value, we will grant you the desired payment method.

How long will this data be stored? Do I have to provide this data?

We may store your data for as long as it is necessary to fulfill the contract. We may store much of your data at least until the contract is fulfilled and thereafter within the regular limitation period. In order to assert or defend legal claims, we may store data until the maximum limitation period has expired.

Pseudonymous user profiles of visitors to our website are created. Google uses permanent cookies (see II.3.). The information generated by the cookie about your use of our website is processed by Google in the USA. This information is the data mentioned above under II.2. The data is stored for a maximum of 14 months. The provision of this data is not mandatory and is not required to conclude a contract with us. Google Ads (Google Adwords)

We use the Google Ads services Google Ads Conversion and Google Ads Remarketing. These are online marketing services from Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (Google). The information generated by these services about your use of our website is processed by Google in the USA.

Google Ads Conversion

We use the online marketing service Google Ads to place ads in the Google advertising network (e.g. in search results, in videos, on websites, etc.) so that they are shown to users who are likely to be interested in our products. Using the online marketing service "Google Ads Conversion", we determine the anonymous number of users who have clicked on our ad in the Google advertising network, are redirected to a page on which a so-called conversion tracking tag is set up, and thus receive information about the conversion of our ads in order to be able to determine how successful our advertising measures are.

This is done by creating a pseudonymous user profile that is stored in a permanent cookie. We cannot identify the users themselves. We only receive the statistical evaluation, which allows us to determine how effective individual advertising measures are.

Google Ads Remarketing

We also use Google Ads Remarketing. This function enables us to present users of our website with advertisements that match their interests on other websites in the Google advertising network. This is done by using a cookie that helps evaluate the user's interaction on our website, e.g. which products the user is interested in, in order to show the user relevant advertisements on other websites after they have visited our website. The cookies used for this purpose are used to identify a web browser, but not to identify a person.

Why is this data processed?

The data is processed for the purposes of market research and the needs-based design of our website and our advertisements. Google processes this data on our behalf in order to evaluate the use of our website and to optimize our advertisements according to the needs of our customers. For this purpose, a contract for order processing was concluded with Google. The processing is carried out on the basis of your consent in accordance with Art. 6 Para. 1 Sentence 1 lit. a) and Art. 49 Para. 1 Sentence 1 lit. a) GDPR, which you can revoke at any time with effect for the future.

How long will this data be stored? Do I have to provide this data?

The data is stored for a maximum of 367 days. The provision of this data is not mandatory and is not required to conclude a contract with us. You can also prevent the processing of the data generated by the cookie by downloading and installing the plug-in available under the following link: http://www.google.com/settings/ads/plugin.

Further information on data protection at Google can be found at google.com/intl/de/policies/privacy and services.google.com/sitestats/de.html .

A/B Testing

We use software from SAS AB Tasty, 3 impasse de la Planchette, 75003 Paris. This enables so-called A/B tests and web personalization. This makes it possible to analyze how users navigate the websites. This enables us to regularly improve our offering and make it more interesting for you as a user.

For this evaluation, cookies and tracking pixels (invisible graphics that are loaded when the website is accessed) are stored on your computer. Before the analyses are carried out, the IP addresses are shortened and processed further, thus preventing them from being directly linked to a person. The IP address transmitted by your browser is not merged with other data collected by us.

Why is this data processed?

The purpose of the processing is to optimize our website. The processing is carried out on the basis of your consent.

Do I have to provide this data?

The provision of this data is not mandatory and is not required for the conclusion of a contract with us. You can prevent the evaluation via your settings (see above, Section II.3). You can also prevent the storage of cookies by setting your browser accordingly.

  1. Fraud prevention

To ensure the security of the order processes, we use the data provided to us to check whether there are any irregularities in the specific order. We have a legitimate interest in doing this, as we want to avoid payment defaults and protect customers from the misuse of their personal data.

When ordering in our online shop, data for contract processing (e.g. object of purchase, name, postal address, email address, delivery address, payment method and bank details) and the usage data of visits to our website (e.g. start, end and extent of use) are processed together with a cookie and/or a visitor ID. These can each contain anonymous data of the end devices used when visiting the website and can be recognized with a certain degree of probability on subsequent visits. The processing is carried out for the purpose of protecting your customer account, the websites you visit and services you use on our website against fraudulent and abusive behavior (e.g. against the takeover of user accounts, the automated creation of fake user accounts or the use of stolen identities or payment data).

If there is a suspicion of fraud or abuse, one of our employees will check the assessment and the underlying evidence. If a contract is then rejected, you will receive a notification. If requested, you will also be given the main reasons for the decision. You will then have the opportunity to state your point of view, after which the decision will be reviewed again by an employee.

We carry out fraud prevention ourselves or with the support of external service providers. The latter process your data exclusively in accordance with our instructions and not for their own purposes. The measures to secure the ordering processes in the online shop are carried out by Creditreform Egli Basel AG, 4002 Basel and data center service providers who have been commissioned to store the data.

The data processed in this context will be automatically deleted after five months.

You can object to the processing of your data as described above at any time, for example by sending an email to datenschutz@thunderbird.ch or with the addition “Data Protection” by post to
